Mark Rienzi, the lead counsel in McCullen v Coakley, the Buffer Zone Appeal, recently filed a cert petition with the Supreme Court. If the court grants cert, it will hear the case and, legal scholars expect, overturn the 35 foot buffer zone. Mark is joined in the appeal by MCFL Board member Phil Moran.
Massachusetts had waived its right to respond to the petition. The Supreme Court would not grant cert without having the response. That meant the Court would either require Massachusetts to respond or reject the petition outright.
Mark told us on Friday that the Court has instructed Massachusetts to respond. This is a huge step in the right direction! Whatever ploy Massachusetts was trying by not responding didn't work and the case is closer to being heard.
