Elena Kagan to SCOTUS - great nominee for Obama

President Obama will nominate U S Solicitor General, Elena Kagan to the Supreme Court.  She is ideal for him, unfortunately.   He wants a nominee who is a 1) guaranteed liberal, who will be 2) nominated easily in this election year, and who will be 3) able to woo Justice Kennedy, the "swing vote".   1)  Poor as he is at vetting in other areas, Obama would never have named her solicitor general if he were not sure she is his kind of liberal. 2)  Kagan has an incredibly sparse paper trail. Even conservatives speak well of her. 3)  Kagan has the cv, the aura, and the personality to be much more powerful with Kennedy than Sotomayor. Rose Drives Save Lives!

State Senate Elections Next Week. We can elect a pro-life candidate!

On Tuesday, May 11, there are two special State Senate elections to replace Senators Gallucci and Brown. There is not a pro-life candidate for the Galucci seat, but the race for the Brown seat is a classic.  It features State Rep Richard Ross who takes a pro-life position, has a pro-life record, and is a Sponsor of our Women'a Right to Know Bill, "Laura's Law" His opponent, Peter Smulowitz, says he is an advocate who will work for "reproductive rights".  He upset a powerful sitting State Rep. in the primary.  He was an organizer in the Obama campaign, so we think it must be the Obama machine that gave him the primary win. Amazing poll results about Roe v Wade and the Supreme Court!

Friday, April 30, 2010 Poll Results   [Ed Whelan] Today's Washington Post article on the latest Washington Post-ABC News poll highlights a couple of interesting results. First, Americans recognize the value of judicial experience in a Supreme Court nominee: [The] poll shows that judicial experience is the most valued quality among a list of professional and personal characteristics. Seven in 10 say service as a judge is a positive quality for a Supreme Court nominee, while only 5 percent see it as a negative. Second, despite the barrage of media claims that the Court is too conservative, Americans recognize otherwise: Overall, 46 percent say the current court is balanced in its decisions, a figure basically unchanged from when the question was asked three years ago. But now, 26 percent consider it too liberal, compared with 21 percent who say it is too conservative. Three years ago, 31 percent called the Supreme Court's rulings too conservative and 18 percent thought they were too liberal. The Left might try to find hope in the report that "six in 10 want the next justice to vote to uphold Roe, while 38 percent say it should be overturned."  But even apart from the fact that the 38% figure is apparently a high, the Roe question is drafted in a way that predictably understates support for overturning Roe. Here's how the question reads: "The Supreme Court legalized abortion 37 years ago in the ruling known as Roe versus Wade. If that case came before the court again, would you want the next justice to vote to (uphold) Roe versus Wade, or vote to (overturn) it?" The phrase "legalized abortion"could easily lead respondents to believe that the effect of overturning Roe would be to make abortion illegal, when it would in fact be to restore abortion policy to the democratic processes. Nor, of course, does the question reveal how extreme the Roe/Casey regime is and how it prevents implementation of measures that Americans overwhelmingly support. As I discussed in this post about a poll three years ago, with even a brief education about what Roe really means, public opinion on overturning Roe swung a full 16 points in the direction favoring the reversal of Roe.          PLEASE SUPPORT OUR LIFE SAVING WORK

"Protect Life Act" would restrict abortion funding in Obamacare

Congressman Joe Pitts (D, Pa) has filed HR5111, "Protect Life Act", which would amend Obamacare to restrict the several different ways in which the measure funds abortions.  HR 5111 restores the Stupak language to ObamaCare.  There are 57 co-sponsors - but only a few of  Stupak's coalition, and not Stupak himself. So far no Massachusetts Congressmen have co-sponsored the bill.  Certainly Congressmen Lynch and Neal, who voted for original language in Stupak, are logical co-sponsors.   Please call your own Congressman urging him or her to co-sponsor HR 5111, the Protect Life Act.  Then please contact someone you know who lives in the Lynch or Neal district and make sure that person calls also.   John W. MODIFYING SPECIAL RULES RELATING TO COVERAGE OF ABORTION SERVICES UNDER THE PATIENT PROTECTION AND AFFORDABLE CARE ACT TO CONFORM TO LONG-STANDING FEDERAL POLICY   (a) In General- Section 1303 of the Patient Protection and Affordable Care Act (Public Law 111-148), as amended by section 10104(c) of such Act, is amended- (1) by redesignating subsections (c) and (d) as subsections (e) and (f), respectively; (2) by redesignating paragraph (4) of subsection (b) as subsection (d) and transferring such subsection (d) after the subsection (c) inserted by paragraph (4) of this subsection with appropriate indentation; (3) by amending subsection (b) to read as follows: `(b) Special Rules Relating to Coverage of Abortion Services- Nothing in this Act (or any amendment made by this Act) shall be construed to require any health plan to provide coverage of or access to abortion services or to allow the Secretary or any other Federal or non-Federal person or entity in implementing this Act (or amendment) to require coverage of or access to such services.'; (4) by inserting after subsection (b) the following new subsection:   `(c) Limitation on Abortion Funding- `(1) IN GENERAL- No funds authorized or appropriated by this Act (or an amendment made by this Act), including credits applied toward qualified health plans under section 36B of the Internal Revenue Code of 1986 or cost-sharing reductions under section 1402 of this Act may be used to pay for any abortion or to cover any part of the costs of any health plan that includes coverage of abortion, except in the case where a woman suffers from a physical disorder, physical injury, or physical illness that would, as certified by a physician, place the woman in danger of death unless an abortion is performed, including a life-endangering physical condition caused by or arising from the pregnancy itself, or unless the pregnancy is the result of an act of rape or incest. `(2) OPTION TO PURCHASE SEPARATE COVERAGE OR PLAN- Nothing in this subsection shall be construed as prohibiting any non-Federal entity (including an individual or a State or local government) from purchasing separate coverage for abortions for which funding is prohibited under this subsection, or a plan that includes such abortions, so long as- `(A) such coverage or plan is paid for entirely using only funds not authorized or appropriated by this Act; and `(B) such coverage or plan is not purchased using- `(i) individual premium payments required for a qualified health plan offered through an Exchange towards which a credit is applied under section 36B of the Internal Revenue Code of 1986; or `(ii) other non-Federal funds required to receive a Federal payment, including a State's or locality's contribution of Medicaid matching funds. `(3) OPTION TO OFFER COVERAGE OR PLAN- Nothing in this subsection or section 1311(d)(2)(B)(i) shall restrict any non-Federal health insurance issuer offering a qualified health plan from offering separate coverage for abortions for which funding is prohibited under this subsection, or a plan that includes such abortions, so long as- `(A) premiums for such separate coverage or plan are paid for entirely with funds not authorized or appropriated by this Act; `(B) administrative costs and all services offered through such coverage or plan are paid for using only premiums collected for such coverage or plan; and `(C) any such non-Federal health insurance issuer that offers a qualified health plan through an Exchange that includes coverage for abortions for which funding is prohibited under this subsection also offers a qualified health plan through the Exchange that is identical in every respect except that it does not cover abortions for which funding is prohibited under this subsection.'; (5) in subsection (e), as redesignated by paragraph (1)- (A) in the heading, strike `Regarding Abortion'; (B) in the heading of each of paragraphs (1) and (2), strike each place it appears `REGARDING ABORTION'; and (C) in paragraph (1), insert `conscience protection, abortion, or' after `State laws regarding'; (6) in subsection (f), as redesignated by paragraph (1), by striking `Nothing' and inserting `Subject to subsection (g), nothing'; and (7) by adding at the end the following new subsection: `(g) Nondiscrimination on Abortion- `(1) NONDISCRIMINATION- A Federal agency or program, and any State or local government that receives Federal financial assistance under this Act (or an amendment made by this Act), may not- `(A) subject any individual or institutional health care entity to discrimination; or `(B) require any health plan created or regulated under this Act (or an amendment made by this Act) to subject any individual or institutional health care entity to discrimination, on the basis that the health care entity does not provide, pay for, provide coverage of, or refer for abortions. `(2) DEFINITION- In this subsection, the term `healthcare entity' includes an individual physician or other health care professional, a hospital, a provider-sponsored organization, a health maintenance organization, a health insurance plan, or any other kind of health care facility, organization, or plan. `(3) ADMINISTRATION- The Office for Civil Rights of the Department of Health and Human Services is designated to receive complaints of discrimination based on this subsection, and coordinate the investigation of such complaints.'. (b) Conforming Amendment- Section 1334(a)(6) of such Act is amended to read as follows: `(6) COVERAGE CONSISTENT WITH FEDERAL POLICY- In entering into contracts under this subsection, the Director shall ensure that no multi-State qualified health plan offered in an Exchange provides coverage for abortions for which funding is prohibited under subsection 1303(c) of this Act.'.

Do you want the bad news first or the bad news first?

When President Obama signed his health-care reform last month, he declared it would "lower costs for families and for businesses and for the federal government." So why, barely a month later, are Democrats scrambling to pass a new bill that would impose price controls on insurance? In now-they-tell-us hearings on Tuesday, the Senate health committee debated a bill that would give states the power to reject premium increases that state regulators determine are "unreasonable." Currently, 27 states have some form of rate review in the individual and small-business markets, but they generally don't leverage it in a political way because insolvent insurers are expensive for states and bankruptcies limit consumer choices. One exception is Massachusetts.  Governor Patrick is now using this regulatory power to create de facto price controls and assail the state's insurers as cover for the explosive costs resulting from our ObamaCare prototype.  Please note that the insurance companies he is controlling are not-for-profit companies seeking to cover their costs. Rationing is intrinsic to price controls in any market.  In health care this will be rationing and denial of care - already starting in Massachusetts; soon to follow nationwide. Call Senator Brown immediately to urge him to vote against this bill which imposes price controls that will ration care to patients and cause insurances companies to go out of business. 317 Russell Senate Office Building Washington D.C. 20510 (202) 224-4543 Now for the bad news! Last week President Obama nominated Donald Berwick as administrator for the Center for Medicare and Medicaid Services (CMS). Under the Patient Protection and Affordable Care Act (Obamacare), the CMS administrator defines the quality of health care for every insurance plan in the country, sets reimbursement rates for physicians in Medicare and Medicaid, and decides what treatments are more "valuable" than others. For the past 15 years Berwick has consulted for - or, in his words, been "starry-eyed" over - Britain's National Health Service. In 2008, at a 60th anniversary of  NHS, he told a UK crowd, "I am romantic about the NHS; I love it. All I need to do to rediscover the romance is to look at health care in my own country." Glad wishes for our friend Hadley Arkes

We are all so grateful to Hadley for all he has done for us and for the pro-life movement.  He has celebrated an important moment in his life.  For that we rejoice with him.  If you would like to send him greetings, I would be glad to forward them.                                                                                                     Anne    April 26, 2010 The operation of divine grace on Hadley Arkes Evelyn Waugh described his masterpiece Brideshead Revisited as a story about "the operation of divine grace on a diverse but closely connected group of characters."  Yesterday, I had the profoundly moving experience of witnessing the operation of grace on a particular person and a diverse group of people who were connected to each other through him.  That person, Hadley Arkes, the Edward Ney Professor of Jurisprudence and American Institutions at Amherst College, was received into the Catholic Church in a beautiful ceremony in the chapel of the Catholic Information Center in Washington, D.C.  Enveloped in the love of his many friends and admirers, Hadley was baptized, confirmed, and received his first communion. Hadley is an outstanding political philosopher and constitutional theorist who has dedicated much of his professional life to defending the dignity and rights of the child in the womb.  In remarks after the service yesterday, he explained that his faith in Christ had come through the Church.  The Church's moral witness, especially on the sanctity of human life and on marriage and sexual morality---a witness that has in our time made the Church a "sign of contradiction" to the most powerful and influential elements of the elite sector of contemporary western culture---persuaded him that the Church is, despite the failings of so many of its members and leaders, fundamentally "a truth-teaching institution."  In teachings that many find to be impediments, Hadley found decisive evidence that the Church is, indeed, what she claims to be. Speaking of his Jewish identity, Hadley said that he neither would nor could ever leave the Jewish people.  His entry into the Church was for him, he stated, a fulfillment of his Jewish faith, and in no way a repudiation of it.  Invoking the testimony and authority of the late Cardinal Lustiger of Paris, he declared that he was and would always remain a Jew, though a Jew who, like the earliest Christians, had come to accept Jesus as "the Christ, the Son of the living God."    Hadley's sponsor was Michael Novak, who read aloud some charming verses he had composed for the occasion.  The other speakers were Daniel Robinson of the Philosophy Faculty at Oxford University, Michael Uhlmann of the Political Science Department at Claremont Graduate School, David Forte of the Cleveland State University Law School, and your humble correspondent.  The chapel was overflowing with people who had come from all over the country.  The spirit of joy was extraordinary.  Part of the reason for that, I believe, is that every person in the room had become a better Christian as a result of Hadley's friendship, long before Hadley himself entered the Church.  More than a few people credited Hadley for their own conversions (or reversions).  Like G.K.
